1. Safety Instructions
All boat operators have legal operating licenses issued by the Marine Department and have purchased third-party liability insurance (HK$10,000,000 coverage as required by Hong Kong law). However, guests are responsible for their own personal and property safety during personal activities. For travellers from foreign countries, we strongly recommend you purchasing comprehensive travel insurance that covers water sports, personal accident, and medical evacuation. This ensures full protection for all travel activities—even before or after our tour and experiences—which may not be covered under our operator liability insurance.

2. Confirmation
Upon receipt of your booking/order. We will manually review your order within 1 hour. Unless you receive a cancellation notice within 1 hour of submission, your booking will be automatically confirmed. During this process, no further notifications are required. Simply arrive at the meeting point on time on the departure day, unless cancelled due to weather or unforeseen circumstances. Should cancellation be necessary, we will notify you as soon as possible via your provided contact details, offering full refund or rescheduling options.
Please again note that confirmation of your order does not guarantee the trip will proceed, as all tours are subject to weather and wave conditions for your safety.

3. Refund Policy
Once the booking is confirmed, a full refund is available for cancellations made at least 7 days prior to the departure date. Otherwise, refunds will only be arranged if the tour is canceled due to bad weather or insufficient participants. Promotional and special-offer products are excluded from this refund policy.
Eligible refund amounts will be returned within 7 working days. No refunds will be provided once the tour has officially departed.

4. Rescheduling Policy:
Once the order is confirmed, a full refund is not available unless a request is made at least 7 days prior to the departure date. However, customers are entitled to one free rescheduling up to 24 hours before the departure date. Please note that changes to the booking date are not permitted within 24 hours of the tour start time.

5. Cancellation policy
5.1. Weather
If the Hong Kong Observatory issues Typhoon Signal No. 3 or above, or a Black Rainstorm Warning within 2 hours prior to departure, all boating activities will be cancelled. You may choose to reschedule your trip or request a full refund.
All cancellations due to weather conditions will be announced 1 hour before departure.
***Splitdyboat reserves the right to make the final decision on whether to reschedule or cancel any trip due to safety concerns, as your safety is our top priority.***
5.2. Insufficient participants.
If the minimum number of participants is not met, Splitdyboat will notify you within 24 hours and arrange for either:

●Rescheduling
●Transfer to another tour

6. Children under 13 years old Must be Accompanied by an Adult
Adults are responsible for overseeing the children's participation and ensuring they follow safety guidelines. This requirement not only enhances safety but also fosters family bonding and shared memories. Thank you for your cooperation in keeping our environment safe!

7. Eligibility Criteria and Health Considerations
Not recommended for those who are pregnant, have heart disease, have poor health, or have sports injuries, especially knee/ankle/neck injuries, to engage in any water or high-risk activities.

8. Not Guarantee to Cross through Sea Arches & Sea Strait
The speedboat cave passing section is not a mandatory part of the Geopark four sea arches volcano sightseeing tour (which means using a speedboat to sail through the gorge between Po Pin Chau and Fa Shan, as well as other sea caves in the itinerary) Based on the wind direction on the day and the professional judgment of the boat operator, this experience is not guaranteed for every itinerary. Safety is our first priority.

9. Travel Route Shift
If the customer and the boat operator negotiate to change the location, all changes in the itinerary have nothing to do with Splitdy Boat Company.

10. Basic Terms and Registration Instructions
Participants must provide correct contact information. After the event registration is confirmed, participants will receive an event confirmation text message via WhatsApp/ WeChat. The confirmation text message will be sent based on the contact information provided by the participant, so please pay attention. Please ensure that the phone number provided during registration can receive WhatsApp/WeChat messages.

11. Please be On Time
You are requested to arrive at the meeting location on time at the meeting time notified by Whatsapp (usually 15 minutes before departure). Latecomers will not be kept waiting.
If you fail to arrive at the meeting point on time, you will be deemed to have voluntarily given up their right to board the boat and no refund will be given. In case of late cancellation or no-show, customers forfeit all rights to rescheduling or refund, and no further changes can be accommodated.

12. If you are Prone to Seasickness ...
The activity is held on a boat. If participants are prone to seasickness or feel uncomfortable, please bring your own medicine. The organizer will not provide any medication to any participant.

13. Please Listen to our Tour Guide's Instructions
Participants are not allowed to leave the group without permission under any circumstances.

14. Please Take Care of your own Belongings
Please do not bring valuables to participate in this event. The organizer does not assume any responsibility or liability for any loss or damage of any kind to any person.

15. About Life Jacket
Participants may request a standard life jacket or buoyancy aid to wear during the activity for safety reasons, but it is not compulsory.

16. What to Wear
Participants are asked to wear light clothing and bring their own changes of clothing, drinking water, hats, sun protection products, and mosquito repellents.
There is a chance that you will get wet due to the waves during the activity.
Please wear windproof and waterproof clothing according to your personal needs.
Avoid wearing belts that can easily loosen items.
All event schedules or contents are subject to change without prior notice.

17. Complimentary Photography Service
Our experience tours or guided tours do not include professional photography services. However, coaches or guides on the itinerary can provide free photography services to participants. They can assist participants in capturing memorable moments during the journey. This service is provided free of charge and is not a mandatory part of the experience or guided tours.
Participants should note that the number and quality of photos may vary due to environmental factors such as wind and wave conditions, lighting, and other weather-related influences. Additionally, human factors may affect photo availability — for example, if certain participants require special care or attention, coaches may not have sufficient time to take photos for other participants. The safety of all participants is our coaches’ highest priority; therefore, photo-taking will always be conducted with safety considerations in mind.
If participants desire additional photos or videos for personal keepsakes, they are encouraged to request this from the coach or guide during the tour. Please keep in mind that unlike dedicated photography tours, experiences such as snorkelling tours, kayaking tours, and similar activities focus primarily on safe and enjoyable participation in the activity itself.
If participants wish to capture more photos, we generally recommend bringing their own photography equipment, such as waterproof phone cases or waterproof cameras like Insta360, GoPro, DJI, or similar devices.

18. The Usage of Photos and Videos during the Tour
The organizer and the tour guide may take photos or videos of participants during the event for promotion or recording purposes; participants of the event may also have the opportunity to review the content captured during the event.

19.Direct Marketing in WhatsApp or Email
We will take all practicable steps to destroy your personal data within a reasonable period after the event date. However, if you do not object to the use of your personal data in direct marketing, we can continue to retain and use your personal data (mainly your name and contact details) to directly market products, services, and activities to you until you feel free to do so at any time. Opt out of direct marketing.

20. Actual Arrangement of the Departure is Subject to Change
The order of pictures / itinerary is for reference only. The actual arrangement is subject to the situation on the day of departure and is subject to change without prior notice. We may encounter force majeure factors such as sudden change in wave condition.

General Terms and Conditions for Yacht Activities
1. Safety and Conduct
Passengers must follow all safety instructions given by the crew and guides. Life jackets must be worn when required. Unsafe behavior or intoxication may result in removal from the yacht without refund.

2. Weather and Conditions
Yacht activities are also subject to weather and sea conditions. The operator reserves the right to alter, postpone, or cancel trips for safety reasons. Full refunds are given for cancellations of tours due to adverse weather.

3. Liability
The operator is not liable for personal injury, loss, or damage to personal belongings. Passengers participate at their own risk.

4. Age and Health Requirements
Participants should be in good health. Children under a certain age may require adult supervision. Pregnant women and persons with certain medical conditions are not recommended to disembark on the yacht.

5. Equipment Use
Although proper instruction and coach guidance will be provided, use of equipment (e.g., snorkelling gear, kayaks, stand-up paddleboard) is at the participant’s own risk.

6. Changes to Itinerary
The itinerary may be modified due to operational or environmental factors without prior notice.

7. Property Care and Damage
Passengers are required to treat the yacht, the speedboat and all onboard equipment with care. Any damage, whether accidental or due to negligence or misuse, may result in the passenger being held financially responsible for the cost of repairs or replacement.

1.3 In addition, when using the Services, you shall be subject to any additional terms applicable to such Services that may be posted on the page relating to such Services from time to time, the privacy policy (the “Privacy Policy”) and the terms and conditions of Splitdyboat AI tools (the “Terms and Conditions of Splitdyboat AI Tools”) adopted by Splitdyboat from time to time. Activity Disclaimer and Assumption of Risk
You confirm that, before registering for and/or participating in any outdoor marine activities, boat activities, water activities, snorkelling activities, boat trips, or other related experiences arranged, assisted, promoted, or coordinated by Splitdyboat (Hong Kong) Travel Limited (collectively, the “Activities”), you have carefully read, fully understood, and agreed to the following terms and conditions. You understand that your signing of this Disclaimer, electronic confirmation, payment of the booking fee, or actual participation in the Activities shall constitute your express acceptance of this Disclaimer and agreement to be bound by its terms. If you make a booking on behalf of other participants, you confirm that you have informed them of this Disclaimer and that they are deemed to have accepted and agreed to be bound by it upon booking, unless we are notified otherwise in writing before the Activities.
1. Nature of the Activities and Assumption of Risk
1.1 You acknowledge and accept that the Activities are outdoor and marine-based in nature and involve inherent risks that cannot be completely eliminated, including but not limited to changing weather conditions, unstable sea conditions, collision, slips and falls, drowning, injury, illness, property loss, and, in extreme cases, death.
1.2 You confirm that you have considered your age, physical condition, health status, swimming ability, pregnancy status, whether you suffer from heart disease, asthma, epilepsy, seasickness, or any other condition that may make you unsuitable to participate, as well as the weather, sea conditions, tides, and activity arrangements at the time, and that you choose to participate voluntarily and at your own discretion.
1.3 You agree to assume all risks, losses, damages, injuries, and consequences arising from your participation in the Activities, and you acknowledge that the Company has recommended that you obtain suitable insurance and make appropriate personal preparations before participation.
2. Compliance with Instructions and On-Site Rules
2.1 You agree to comply during the Activities with all reasonable safety instructions, rules, and arrangements made by the Company, the captain, crew, guides, coaches, and other authorized personnel.
2.2 You understand that, for the safety of the Activities, the operation of the vessel, and the interests of other participants, the captain and/or the Company’s representative may, on safety, order, or any other reasonable grounds, require you to stop any action, leave any designated area, or immediately terminate your participation in the Activities, and that such decision shall be final and binding.
2.3 If you refuse to follow reasonable instructions, engage in conduct that endangers safety, interfere with the Activities, or behave improperly, recklessly, violently, or unlawfully, the Company and/or the vessel operator may immediately terminate your participation, and any fees, deposits, or other sums paid shall be non-refundable. The Company also reserves the right to pursue any losses incurred.
3. Damage to Equipment, Vessels, and Third-Party Property
3.1 You agree to properly use and take care of the vessel, equipment, safety gear, flotation devices, snorkeling equipment, and other related facilities, and shall not tamper with, dismantle, damage, or misuse any equipment without authorization.
3.2 If, due to your negligence, improper use, wilful act, breach of safety instructions, or any other act attributable to you, damage, loss, or repair/replacement cost is caused to the vessel, equipment, tools, Company property, vessel operator’s property, or any third-party property, you agree to bear full responsibility for compensation, repair, replacement, and any related legal costs.
3.3 The Company and/or vessel operator may record, photograph, video, assess, and request compensation within a reasonable time for such damage. Where necessary, the Company may recover from you all actual losses and related expenses.
4. Personal Belongings
4.1 You understand that all personal belongings, cash, electronic devices, jewelry, identification documents, and other items you carry are your own responsibility.
4.2 In the event that any personal belongings are lost, stolen, damaged, wet, or destroyed during the Activities, the Company, vessel operator, captain, crew, and any of their agents or employees shall not be liable, except to the extent that liability cannot be excluded by law.
5. Insurance and Medical Matters
5.1 You understand that any insurance provided by the Company and/or vessel operator is limited to the compulsory third-party liability insurance required under Hong Kong law, and that such insurance generally covers legal liability for bodily injury, death, or property damage to third parties arising from negligence in vessel operation. It does not cover your personal accident, medical expenses, cancellation, delay, or loss of personal property arising from any cause, including but not limited to your own negligence, health condition, or weather.
5.2 You confirm and agree that the Company has recommended that you obtain adequate and suitable personal travel insurance, accident insurance, and medical insurance to cover any risks, losses, or medical needs that may arise during the Activities.
5.3 If you feel unwell, are injured, or suspect that you require medical assistance during the Activities, you agree to immediately notify the captain, crew, or the Company’s representative and accept any necessary assistance or emergency arrangements they make.
6. Indemnity and Release
6.1 To the fullest extent permitted by law, you agree to release, waive, and discharge the Company, vessel operator, captain, crew, guides, coaches, and their respective employees, agents, and contractors from any and all claims, liabilities, demands, actions, costs, or expenses arising out of or in connection with your participation in the Activities, except to the extent that such liability cannot be excluded by law.
6.2 If your conduct, default, breach, or unlawful act causes the Company, vessel operator, or any third party to suffer loss, claim, fine, expense, legal costs, or other damage, you agree to fully indemnify and hold harmless the relevant party.
7. Collection and Use of Personal Data
7.1 You consent to the Company collecting, holding, using, and retaining your personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) for purposes directly related to the Activities, including registration, identity verification, contact, emergency contact, activity arrangements, security, record-keeping, and related administrative purposes.
7.2 The personal data collected by the Company may include, without limitation, name, telephone number, email address, emergency contact details, age/date of birth, health or safety-related information, and other information necessary for activity arrangements; the provision of such data may be mandatory where required for the Activities or voluntary depending on the circumstances.
7.3 You understand that the Company will take reasonable and appropriate measures to protect personal data security and will retain such data only for the period necessary to fulfill the purposes stated in this Disclaimer and to comply with legal requirements.
7.4 You understand that, under Hong Kong law, you have the right to request access to and correction of your personal data, and such requests may be made through the contact details provided by the Company.
8. Governing Law and Jurisdiction
8.1 This Disclaimer shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
8.2 Any dispute arising out of, in connection with, or relating to this Disclaimer, the Activities, their interpretation, performance, or otherwise, shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
9. Final Acknowledgement
You confirm that you have read, understood, and accepted all terms of this Disclaimer, Assumption of Risk, Release of Liability, and Indemnity, and that you have had the opportunity to seek independent legal advice regarding its contents. You voluntarily agree to be bound by this Disclaimer and confirm that the above terms are binding to the extent permitted under the laws of Hong Kong.
